1. It is the agent's responsibility to ensure that the listing is ready for the virtual tour to be produced at the arranged time.

2. The photographer accepts no responsibility for the condition and/or cleanliness of the property at the appointed time for the tour to be shot. The photographer will not handle any cleaning, dusting, moving of furniture, or any other items that may be within the designated shooting area. The photographer will only, at his or her discretion, adjust blinds, shades curtains, or turn on or off lights
as deemed necessary to better capture the scene(s). The home must be clean and presentable at the scheduled time of the tour. If photographer must return the charge will be an additional $25 charge to the agent.

3. The agent and or homeowner must be present at the scheduled time of the tour (unless prior arranged with 360Pixs).

4. Customer shall ensure that the photographer is safe and is not disturbed during the scheduled appointment.

• I. All Animals shall be kept away from the photographer.
• II. Photographer shall not be responsible for Animals/Pets that escape the property during the photography session.
• III. Children are supervised by their custodian or parent and out of the camera's view

5. 360Pixs guarantees that all significant aspects of the property shall be included in the tour unless the condition of said aspect has a negative impact on the tour. This shall be left solely up to the discretion of the photographer, unless specific aspect(s) of the property are specifically requested by the agent.

6. If the weather threatens to prevent photography, the agent shall be given the option to continue or to reschedule. If the agent decides to continue the photography session, 360Pixs shall not be responsible for the outcome of the tour. Outside shots will not be done under unfavorable weather conditions.

7. The agent must provide the valid address of the home with any manual code for access.

8. 360Pixs will charge the agent $25 cancelation fee for order that are cancelled within less that 24 hour notice. Cancellations must be done via email (info@360pixs.com ) or fax ( 202 318-6090).

9. In the event that the agent does not call or meet the local photographer within thirty (30) minutes of the scheduled time that they agreed upon, (no show), and or provide access to the home then the charge will be $25 to the agent.

10. Once the photographer has photographed a home, the tour may not be canceled. The agent will be charged the full price of the tour.

11. All Virtual Tours and Still Photos will be available for viewing whit in 24-48 hours of the Photo Shoot including Still Images that the agents use for brochures ect.

*The virtual tour will be done without the MLS number. 360Pixs.com will post the virtual tour on line with a temporary URL for your review until then .The agent is responsible to give 360PIXS.com the MLS number when the property is put on the MLS.

General Linking Information:

• Listing information must be on requested site before we can post virtual tours there. It is agent's responsibility to get listing on sites.

• We must have required listing information before we can post tours to requested websites (i.e. correct MLS number and address of home).

• We only post virtual tour links, we are not responsible for getting still images onto MRIS or other websites.

• 360Pixs.com has the ability to post directly to Realtor.com. In order to post an agent's virtual tour, the listing needs to be on this site and 360Pixs.com must have the necessary information to post the home (MLS number, correct address, etc.) Once 360Pixs.com posts the tour to Realtor.com, 360pixs.com is not responsible for the reliability of their servers. There are associated posting fees with Realtor.com. There is a $25.00 posting fee to post to Realtor.com. When posting to Realtor.com, this generally takes 24-72 hours from the time that the tour is posted on MRIS.

• All Virtual Tours will be maintained and hosted for a period of (1 Year ) or until the status changes from ACTIVE to SOLD in the MRIS.

Refund Policy:

• The client can only receive a full refund if the Virtual Tour was canceled more than 24 hours prior to the original scheduled time.

• Once the photographer has photographed a home, the tour may not be cancelled. The client will be charged the full price of the tour.

• If an agent is not happy with the photographs taken of a home, he or she may request a reshoot within 30 days of ordering the tour. The photographer will come and take pictures of the same home for a nominal "reshoot fee $45". After 30 days, the full tour price will be charged.

360Pixs.com keeps the copyright protection of all web pages and digital images. We reserve the right to use all images for promotion of 360Pixs.com but not a third party. The Agent / REALTOR®, who paid for this service, has permission to use these virtual tour images on any electronic or printed form of advertisement for the promotion of that property. Images cannot be altered after they are in your possession. Failure to pay for the images will result in a copyright infringement / violation. You will be asked to remove the image from any electronic or printed form of advertisement. Failure to stop using them will become a legal matter.
